The European Commission has opened two infringement proceedings against Portugal for failures in the transposition of European Union (EU) legislation on new varieties of fruits and vegetables and also on the marketing of seeds.
Regarding the incomplete transposition of Directive (EU) 2024/2963 of the Commission, the community executive, in a notification letter, gives Portugal two months to report the full alignment of national legislation with EU rules on the admission of new varieties of agricultural plant species and horticultural species with the protocols established by the Community Plant Variety Office (CPVO).
Regarding Directive (EU) 2024/3010 of the Commission, Portugal must also inform Brussels, within a two-month deadline, of compliance with the bloc's legislation regarding the marketing of seeds, other propagation materials, and plants with the requirements established by EU phytosanitary legislation.
In the absence of satisfactory responses in both cases, Brussels may proceed to the second stage of the infringement process, with the sending of a reasoned opinion.
