Italian breeders get jail time and a fine for propagating breed-protected variety

Eight months' imprisonment and €20,000 fine for illegally propagating tomato plants of a breed-protected variety. The court of Ragusa convicted Gaetano Senia and Bartolomeo Bernini, legal representatives of a plant nursery in Vittoria, in the province of Ragusa, where a protected tomato variety was grown without the required licenses.

Plantum is bringing the lawsuit to the attention of the public on its website. According to the industry association, it is the second ruling of its kind in Italy.
