UK: Clarification on using crop residues for Anaerobic Digestion

Clarification from the Environment Agency (EA) has highlighted that biogas producers will no longer have to register an exemption or pay for a permit in order to use fruit and vegetable by-products in the anaerobic digestion (AD) process.

The EA’s new briefing note differentiates ‘crop residues’ from food waste when used for anaerobic digestion. Until now the inclusion of even small quantities of these by-products in the AD process required growers to apply for expensive permits, and to implement the same waste handling controls as commercial food waste AD plants.

‘Crop residues’ constitute misshapen, bruised or undersized fruit and veg separated out as being unsuitable for sale, or parts of fruit and vegetables including leaves, roots and tops removed as part of processing in a pack-house, on farm or grower site. It is hoped this clarification will remove any unnecessary legislative burden for users of AD.
