Murcia's Provincial Court has ratified the sentence that will force some seed breeders and their insurer to pay 150,000 euros to two producers, as they are deemed responsible for the loss of some tomato seeds that had been given to them for germination.
The Court reports that the two producers sued the company S.T.M., S.L. because of the losses resulting from the poor treatment given to seeds of the Delizia tomato variety, which had been acquired for the production of seedlings.
The plants were allegedly lost in the greenhouses as a result of the application during the germination process of an unsuitable phytosanitary product.
This treatment caused the plants to become "blind" and therefore did not give the desired output.
In dismissing the appeal filed by the defendant, the Court says that the cause of the loss of the tomato plants is considered proven.
Thus, it states that there was no climate phenomenon that could have taken a toll on the plants' development and that no other reason for their defective growth could be found, other than the application of the phytosanitary product.
